Many companies are unaware that they carry out eligible R&D activities as part of their day-to-day operations and could therefore benefit from a valuable R&D tax incentive. For profitable companies, the incentive is credited against their corporate tax liability. In the event of a loss, the full amount can be paid out, providing additional liquidity that can, for example, be reinvested in further innovation and growth. Companies in Germany can claim up to €4.2 million per year in eligible research and development (R&D) costs retrospectively through the German R&D tax incentive scheme. The German Research and Development Allowance Act (Forschungszulagengesetz), which came into effect on January 1, 2020, provides an attractive opportunity to optimize operating costs and R&D budgets. The incentive is relevant to all companies subject to corporate taxation in Germany. The annual assessment base for eligible R&D expenditure is capped at €12 million per group of affiliated companies and fiscal year, with a standard funding rate of 25% and 35% for SMEs. For projects commencing on or after January 2, 2026, companies can, for the first time, claim a flat-rate 20% allowance for overhead and operating costs in addition to eligible R&D expenditure. The R&D tax incentive is credited against the company’s income tax liability and is also paid out during periods in which the company incurs losses. In principle, all types of research and development projects may qualify for funding.
